Ley 10 de 1994: who does what in Puerto Rico real estate

Start with the definitions in Artículo 2, because the exam returns to them constantly. The vendedor is the natural person who, holding a licence from the Junta, is employed or contracted by a corredor and works under that corredor's dirección, control, supervisión y responsabilidad; the corredor is the one who may run an independent real estate office. The vendedor is also obliged to keep the Junta informed at all times of the place where he or she works. Artículo 3 creates the Junta itself and attaches it to the Departamento de Estado, a small fact that appears as a straight recall question. Artículo 11 then defines the vendedor's entry requirements by reference: the aspirante a vendedor meets the same requirements as the corredor except the carved-out items, which means no 60 university credits and no own cuenta de plica. Finally, Artículo 20 lets the Junta establish reciprocity, granting licences without examination to professionals from states, territories or countries that impose similar requirements and extend the same courtesy to Puerto Rico licensees.

The Código Civil de 2020: the property questions

The derecho de superficie has its own cluster: the landowner must refrain from any act that disturbs the superficiario (Arts. 977 to 979), and if no duration was fixed and the parties cannot agree, the court sets a term sufficient for the purposes the parties pursued (Art. 987). Community property may be divided by the interested parties, by arbitrators or mediators named by unanimous agreement, or by the court (Arts. 854 to 855). And the contract rules produce classic exam items: if two adjoining owners exercise the retracto at once, the owner of the smaller adjoining tract is preferred (Arts. 1057 to 1059), and an exchange where one side gives money equal to or greater than the value of the thing is not a permuta but a compraventa (Arts. 1293 to 1294).
